Public offer agreement
1. General Provisions
This document is a public offer and an accession agreement defining the terms of sale of goods through the nb.in.ua website in accordance with Ukrainian legislation.
Before completing the order, the buyer is given the opportunity to review information about the selected product, its price, available payment and delivery terms, and the terms of this offer. The legal moment of acceptance of the offer and the conclusion of the contract is defined in Section 7 of this document.
The terms "seller", "buyer", "site", "order" and "goods" are used in this agreement in their usual sense in accordance with the content of the legal relationship between the parties.
2. Legal seller and contact details
The seller of the goods and a party to this agreement is Media Hub LLC, EDRPOU 41544263, legal address: 01001, Ukraine, Kyiv, Khreshchatyk St., 27A, office 28. The sale of goods is carried out through the website nb.in.ua.

Opening hours: from 9:00 to 22:30, seven days a week, Kyiv time.
- Telephone inquiries are processed within the specified work schedule.
- Email requests are processed within the specified work schedule; responses are provided within 2-3 hours of receipt.
- Upon request for a call back, the seller will call back within 2 minutes within the specified working hours.
- Telegram requests are processed within 2 minutes during the specified work schedule.
3. Site status and use of brand designations
The nb.in.ua website is managed by Media Hub LLC, EDRPOU 41544263, legal address: 01001, Ukraine, Kyiv, Khreshchatyk St., 27A, office 28.
The website operates as an independent seller of genuine New Balance products. nb.in.ua and Media Hub LLC are not official New Balance representatives, are not affiliated with the brand, are not the brand's official website, and do not hold the status of an authorized partner.
The New Balance trademark, associated trade names, logos, and product and service marks are not owned by nb.in.ua or Media Hub LLC. The corresponding designations belong to their respective owners and are used on the website solely for product identification and description.
4. Remote work format
Products are sold remotely through the website nb.in.ua.
Storage and assembly of goods is carried out at the same address where the legal entity is registered (specified in Section 2); however, this premises is not a point of issue of goods and is not intended for personal servicing of customers.
Media Hub LLC does not operate a brick-and-mortar store, does not offer pickup, and does not accept customers in person. Customer service and order processing are exclusively online.
5. Subject of the agreement
Under this agreement, the seller undertakes to deliver the ordered goods to the buyer, and the buyer undertakes to accept and pay for them in accordance with the terms and conditions published on the website.
The items sold may include footwear, clothing, and accessories. Specific product specifications, size, color, configuration, price, and availability are indicated on the relevant product card and are part of the information available to the buyer when placing an order.
The specifications, size, color, configuration, price, and availability information displayed to the buyer when placing an order are current and final at the time and do not require further confirmation from the manager.
The sale and delivery of goods under this agreement are carried out within Ukraine.
6. Ordering procedure
The buyer independently places an order through the website's checkout functionality. The order is placed without registration and does not require a preliminary call, correspondence, or separate approval from a manager.
To place an order, the buyer provides their name, phone number, email address, and the necessary delivery details.
Before final order confirmation, the buyer is shown the selected product, size, quantity, price, shipping cost, and final order details. The information shown to the buyer at this stage is current and final for the order being placed.
After placing an order, an order confirmation page is displayed on the website. An additional notification of receipt of the order by the seller may be sent to the email or phone number provided by the buyer.
Failure to receive a call from a manager does not cancel a properly completed order and is not a condition for its validity.
7. Acceptance of the offer and the moment of conclusion of the contract
Acceptance of this public offer is determined by the buyer performing an action through the website's functionality that, according to the content of the relevant page or form, is clearly aimed at completing the order and transferring it to the seller, regardless of the technical method of implementing such an action or the name of the corresponding interface element.
The contract between the buyer and Media Hub LLC is considered concluded upon receipt of a properly completed order by the seller. A confirmation page, order number, or automatic notification may confirm receipt, but does not constitute an additional condition for the conclusion of the contract.
Browsing the website and its information pages, adding a product to your shopping cart, requesting a consultation, requesting a call back, or clarifying product specifications does not in itself constitute acceptance of the offer and does not create an obligation to purchase the product unless the corresponding action constitutes a properly executed order.
8. Product price and total order cost
All prices on the website are displayed in UAH. The price displayed to the buyer during checkout is the final price for that order.
The shipping cost is displayed separately from the product price before the order is confirmed. The buyer can see the total before completing the checkout process.
Once the contract is concluded, the seller does not unilaterally change the price of the completed order. Hidden fees or mandatory surcharges not disclosed to the buyer before order confirmation are not charged.

9. Payment for the order
The buyer pays for the order upon receipt via Nova Poshta LLC. Payment upon delivery is made through NovaPay LLC.

10. Fiscal receipt
After payment, the buyer is provided with a fiscal receipt. It is generated upon payment and sent to the email and/or phone number specified by the buyer in the order.

11. Delivery of goods
Orders are delivered throughout Ukraine using the carrier Nova Poshta LLC.
Delivery times, costs, and available methods of receiving your order are specified on the Delivery and Payment page.
12. Review and Opt-Out
Before payment, the buyer has the right to refuse the order without having to provide a reason for such refusal. In this case, the buyer will not be responsible for any product, shipping, return shipping, fees, or other charges associated with the order.
The actual receipt of the goods is considered to be their delivery to the buyer.

13. Cancellation of a placed order
The buyer can cancel an order before it is delivered to the carrier by contacting the seller at +380 800 351 659 or by email at sale@nb.in.ua . Registration or authorization is not required.
If the goods have been handed over to the carrier, the buyer may exercise the right to refuse to accept them in accordance with section 12 of this offer.
There are no hidden fees for cancelling or refusing to receive an order.
14. Exchange and return of goods of proper quality
The buyer has the right to exchange or return goods of proper quality in accordance with the rules published by the seller.

15. Warranty and hidden manufacturing defects
The purchased product is covered by a warranty against hidden manufacturing defects. Warranty claims are processed directly by the legal seller, Media Hub LLC.
This warranty does not constitute a statement of the manufacturer's international warranty and does not imply the seller's status as an authorized service center or authorized partner of the brand.
The terms, criteria, and procedures for reviewing warranty claims are outlined on the Warranty page. A warranty claim regarding a manufacturing defect is a separate mechanism and does not replace the rules for the exchange or return of a new, quality product, as provided in Section 14.
16. Refunds
In cases where, as a result of a product return or warranty claim, the buyer is entitled to a refund, it will be made in monetary form in accordance with the published procedure.
The refund method is determined based on the actual payment method used: to the original payment method or, if provided for by the relevant procedure, to the IBAN or card specified by the buyer in the application.
No additional fees or deductions will be applied to the buyer's balance. Bonuses, certificates, or store credit will not be offered as a substitute for a cash refund.
The refund procedure, depending on the reasons for the request, is defined on the Return and Exchange Rules and Warranty pages.
17. Rights and obligations of the seller
The seller undertakes to deliver to the buyer the goods corresponding to the placed order and, prior to placing the order, to provide accurate information about the goods, their characteristics, price, payment, and delivery.
The seller's responsibilities include transferring the completed order to the carrier in accordance with the published terms, providing a fiscal receipt, processing exchange, return, and warranty requests, and properly handling the buyer's personal information.
The delivery rules are provided on the Delivery and payment page, the exchange and return conditions are on the Return and exchange rules page, and the warranty service procedure is on the Warranty page.
If fulfilling a specific order becomes objectively impossible, the seller will notify the buyer and ensure that the matter is resolved in accordance with this agreement and the published rules. The seller does not reserve the arbitrary right to cancel properly placed orders.
18. Rights and obligations of the buyer
The buyer is obliged to provide accurate information necessary for the order processing and delivery, and to check the order composition, size, quantity of goods, and the reflected price before confirming.
The buyer has the right to receive and pay for the order using the chosen available method or refuse to receive it before payment is made in accordance with this offer.
When using the purchased product and requesting an exchange or return, the buyer complies with the published terms of use and the relevant rules of the seller.
The buyer will not be subject to any additional obligations, fees or contractual terms not disclosed prior to placing the order.
19. Liability of the parties and force majeure
The seller and the buyer are responsible for the fulfillment of their obligations under this agreement and the legislation of Ukraine.
The seller is liable to the buyer for any discrepancy between the delivered goods and the placed order, in particular for the incorrect model, size, color, article number or configuration, as well as for a confirmed manufacturing defect within the established warranty review procedure.
The carrier's actions or technical failures of third-party services do not prevent the buyer from contacting Media Hub LLC directly to resolve any issues related to the performance of this agreement. The contractual relationship under this offer arises between the seller and the buyer.
Military operations, extended infrastructure outages or disruptions, natural disasters, and other force majeure circumstances may temporarily affect fulfillment deadlines. If a delay occurs, the seller will provide the buyer with up-to-date information on the order's progress.
The occurrence of force majeure circumstances does not in itself cancel the obligation to return the funds received by the seller and subject to return to the buyer in accordance with this agreement.
20. Buyer's personal data
Personal data provided by the buyer is used for order processing, payment, delivery, and service. Detailed rules for processing this data are set forth on the Privacy Policy page.
Data processing is necessary to fulfill an order, not a marketing subscription. Providing separate consent to receive marketing messages is not a condition of purchasing a product.
By placing an order, the buyer confirms their agreement with the terms of the Public Offer Agreement and the Privacy Policy . Clicking the checkout button constitutes confirmation; without it, the order cannot be placed.
21. Customer appeals and dispute resolution

The request does not require registration or authorization and should not be submitted via messenger. Following the review of the request, the buyer will receive a response or a specific reason for the denial of the claim.
This offer does not establish a complex mandatory claims procedure as a precondition for a refund and does not limit the buyer's right to appeal to competent government agencies or to the court in accordance with Ukrainian legislation.
22. Validity period and amendments to the public offer
The current version of this public offer comes into force on September 14, 2026.

If accepted by the seller, the new version of the offer will be published on the nb.in.ua website. The changes apply to legal relationships arising after their entry into force and do not apply retroactively to existing orders.
Each order is subject to the terms and conditions in effect at the time of its placement. The seller cannot unilaterally change the price or other agreed-upon terms of a placed order.
